Matthew Casey is a seasoned business lawyer with particular experience representing financial institutions. For more than two decades, he has focused his regional practice intensely in the areas of commercial loan documentation, commercial loan workouts and bank-related litigation. Matthew has advised upon and facilitated numerous and successful loan workouts involving industrial facilities, shopping centers, real estate developments, auto suppliers and other projects.

  • Assists clients in negotiating forbearance agreements, loan restructurings and liquidations including sales pursuant to the Uniform Commercial Code.
  • Enforces loan agreements through foreclosure and injunction proceedings and litigates numerous cases involving fraud and fraudulent transfers as part of commercial loan workouts.
  • Assists financial institutions in all aspects of commercial loan documentation.
  • Defends financial institutions in litigation pending in state court, bankruptcy court and district court, including contested foreclosure proceedings.
  • Represents secured creditors in commercial and consumer bankruptcy proceedings under Chapters 7, 11 and 13.

  • Represents clients in various adversary proceedings in bankruptcy court, including preference and fraudulent transfer proceedings, nondischargeability proceedings, and proceedings to determine the validity and priority of various claims or interests.
  • Represents secured creditors in workout negotiations, commercial foreclosure and state court receivership proceedings.
  • Advised financial institution regarding the auction and sale of promissory notes and loan documents resulting in collections nearing $10 million.
  • Advised regarding the wind-down and liquidation of automotive supplier resulting in recovery of loan facilities in excess of $20 million.
