Happy Friday! Steve Palazzolo brings you an impromptu Warner Employment News from the Law Shanty video about these two important topics:
- The second part of the Fair Labor Standards Act (FLSA) Salary Level Test takes effect Jan. 1, 2025.
- Changes to the Earned Sick Time Act.
The FLSA Salary Level Test’s automatic accelerator is troubling for many employers, and the oral argument challenging that regulation is being heard in a Texas court today. Although a court ruling will not be made today, Steve sheds light on the two possible outcomes and what they could mean for employers going forward.
Also today, a bill was introduced to the Michigan legislature that proposes changes to the Earned Sick Time Act (ESTA), clarifying uncertainty surrounding independent contractors and front-loading sick time. Steve offers his perspective on these proposed changes, noting these changes could make things a little easier for HR departments.
Until these proposed changes become law, employers should continue taking steps to comply with ESTA. Warner designed a policy offering available for $400. If you are interested in the policy offering or have questions regarding the proposed changes to the ESTA, please reach out to a member of the Labor and Employment Practice Group or your Warner attorney.
And Steve blesses us with his beautiful singing voice – something you won’t want to miss!
