In today’s episode of Warner’s Legal News for the Cannabis Industry, Warner partner Gaëtan Gerville-Réache addresses the arduous process of obtaining recreational marijuana licenses from local municipalities. Stiff competition exists — so it is important to understand the application process and your rights if problems arise with the result. In this video, Gaëtan reviews:
- The selection criteria municipalities use to grant licenses.
- The scoring process and what you can expect.
- How to challenge the decision if there are issues.
Municipalities have some discretion to select criteria and assign a weight to each one as they deem appropriate for their municipality. However, those criteria must align with the Michigan Regulation and Taxation of Marihuana Act — meaning they must be designed to select applicants best suited to operate in compliance with MRTMA within the municipality.
Gaëtan stresses the importance of hiring an experienced attorney to help you through the complex and unpredictable process, and to help you decide whether to challenge the municipality’s decision or ordinance if you are not granted a local license.
