On this cold and gloomy February day, Steve Palazzolo speaks to us from the Law Shanty on what employers can and cannot do when former employees refuse to give equipment, tools or other company assets back. Over the past few years, when employees were sent home due to COVID-19 restrictions, many employees worked remotely or held onto company assets or materials out of necessity or convenience. Many employees returned to work, but some did not. Now, employers are perplexed with what action is permissible to retrieve those assets or materials from former employees. Steve cites the Fair Labor Standards Act and the Michigan Payment of Wages and Fringe Benefits Act, providing insight into the rules and regulations employers must follow when seeking payment or retrieval of those assets or materials.
