Teleworking and FLSA and FMLA – Give Me a Break

In today’s episode of Warner Employment News from the Law Shanty, Steve Palazzolo discusses the U.S. Department of Labor’s Wage and Hour Division’s Field Assistance Bulletin 2023-1 issued in February of this year. The bulletin provides guidance related to:

  • Teleworking and general employee breaks under the Fair Labor Standards Act.
  • Teleworking and employee breaks to pump breast milk under the PUMP Act.
  • Teleworking and employee leave eligibility under the Family Medical Leave Act.

The bulletin serves as a good reminder of employer obligations under the FLSA and FMLA when employees are working remotely and away from workplace premises.
