Gaëtan Gerville-Réache has represented numerous well-respected organizations in appeals to both the state and federal appellate courts. He has substantial appellate experience in the areas of environmental law and land-use permitting, with a focus on representing mining companies, in addition to his experience litigating disputes under the National Environmental Policy Act and Uniform Commercial Code. Gaëtan was recently awarded Michigan's 2009 Distinguished Brief Award by a panel of jurists and professors for his amicus brief to the Michigan Supreme Court on behalf of Michigan Defense Trial Counsel in support of Auto-Owners Insurance Company.

    • Aggregate Industries - Central Region v. Waterloo Township, 09-01248-AA (Mich. Cir. Ct. July 9, 2009) (persuaded the circuit court to grant an expedited appeal, reverse the township's adverse zoning decision, and grant a special land use application to Aggregate Industries for mining)

    • United States v. Huntington National Bank, _ F.3d _, 2009 WL 2213468 (6th Cir. 2009) (persuaded the Sixth Circuit to reverse and remand an adverse decision in a three-quarter-million-dollar ancillary criminal forfeiture proceeding)

    • Kyser v. Kasson Township, No. 136680, (Mich. leave granted Apr. 29, 2009) (filed brief on behalf of Michigan Aggregates Association as amicus curiae in high-stakes challenge to constitutional zoning/mining standards that have not been reviewed by the Michigan Supreme Court in 25 years) (Amicus Brief)

    • Benefiel v. Auto-Owners Insurance Co., 759 N.W.2d 814 (Mich. 2008) (as amicus curiae, successfully persuaded the Michigan Supreme Court to reverse the court of appeals and hold that a plaintiff who suffers successive injuries has the burden of proving a current injury was caused by the subject accident, not an independent occurrence) (Amicus Brief)

    • National Wildlife Federation v. Michigan Department of Natural Resources, No. 08-263-AA (Mich. Cir. Ct. Mar. 3, 2009) (successfully defeated a third-party appeal of the State of Michigan land-lease to our client and achieved early dismissal of ancillary claims using cutting-edge theories of constitutional and jurisdictional law) 

    • Bill Smith Sand & Gravel v. Alamo Twp., No. 281936 (Mich. Ct. App. Mar. 5, 2008) (persuaded the Michigan Court of Appeals to expedite consideration and summarily affirm the dismissal of a local township’s challenge to the client's mining project)

    • Moore v. Detroit Entertainment, LLC, 755 N.W.2d 686 (Mich Ct. App. 2008) (obtained affirmation of a $600,000 jury verdict for false imprisonment and violation of the civil rights act, persuading the court to follow federal precedent in lieu of Michigan Supreme Court precedent)

    • Mursch v. Hope Township, No. 06-0144-CZ (Mich. Cir. Ct. 2006) (successfully defended appeal to Barry County Circuit Court that challenged regional mining company's special land use permit to mine sand and gravel in Hope Township)

    • In re Kennecott Eagle Minerals Co., Nos. 272220, 271582, 272385 (Mich. Ct. App. Sep. 14, 2006) (conceived and authored the prevailing legal theory that resulted in summary reversal of a lower court's order enjoining the processing of our client’s mining permit application)
