Warner Attorney Authors Chapter on Appeals for Michigan Basic Practice Handbook

Gaëtan Gerville-Réache, an attorney with the law firm Warner Norcross & Judd LLP, has co-authored the chapter on appeals for the new edition of the Michigan Basic Practice Handbook.

The Michigan Basic Practice Handbook, published by the Institute of Continuing Legal Education, covers a wide variety of topics including court procedure and core concepts for every major practice area.  The chapter covers the nuts and bolts of an appeal, pertinent statutes and rules, important case law, and useful practice pointers.  It outlines the basic structure of the appellate courts, explains appellate doctrines such as preservation, waiver and review, and provides a how-to guide to the appellate process, including how to obtain a stay of proceedings, file a delayed application, cross-appeal or emergency appeal, extend briefing deadlines, move for peremptory or other relief and more.

“It is a basic guide for handling simple appeals to Michigan's Circuit Courts, Court of Appeals and Supreme Court,” said Gerville-Réache.  “It is designed to give counsel who do not regularly practice in Michigan's appellate courts a quick reference to and overview of the essential concepts and rules.  With the information provided in this chapter, counsel can avoid the major procedural pitfalls that await the unwary and handle basic appeals with confidence.”

Gerville-Réache has extensive experience with state and federal appeals and administrative appeals.  In 2009, he was awarded Michigan's Distinguished Brief Award by a panel of jurists and professors for his amicus curiae brief to the Michigan Supreme Court on behalf of Michigan Defense Trial Counsel.  He was named as a Michigan Super Lawyer Rising Star in 2012.

Active professionally, he serves on the Executive Committee of the Council of Appellate Lawyers for the American Bar Association and on the Council for Appellate Practice with the State Bar of Michigan.  He also is a member of the Grand Rapids Bar Association, Michigan Supreme Court’s Advocates and Michigan Supreme Court Historical Society.
